Senate Bill (SB 18) was a previous eminent domain bill passed by the 2011 Legislature requiring entities to report to the Comptroller's office regarding their eminent domain authority via certified mail.
After it became effective in 2011, Senate Bill 18 required public and private entities in Texas claiming eminent domain authority to submit a letter to the Comptroller’s office by certified mail, return receipt requested, on or before December 31, 2012. In the letter, these entities were required to report whether they were authorized by the State to exercise eminent domain authority and identify the provisions of state law granting that authority. An entity that was created or that acquired eminent domain authority on or after December 31, 2012, was not subject to this reporting requirement. Unless an entity submitted a letter in accordance with the requirements of Senate Bill 18, its eminent domain authority would have expired on September 1, 2013.
