(AUSTIN) — Acting Texas Comptroller Kelly Hancock today announced the publication of proposed rules to implement the Education Savings Account (ESA) Program, the first statewide school choice plan in Texas.
“Every Texas child deserves the opportunity to learn, grow and succeed in the environment that works best for them and their family,” Hancock said. “It’s important that the rules for our first school choice program adhere strictly to the enacting legislation and keep us on track to have the program ready for families by the 2026-27 school year. With input from parents across the state, we’ll make sure the ESA program reflects the best of Texas — freedom, accountability and a commitment to the next generation.”
The 89th Texas Legislature created the ESA Program through Senate Bill 2, signed into law in May. The Comptroller’s office will administer the program, with day-to-day operations support from one or more Certified Educational Assistance Organizations (CEAOs). Earlier this summer, the agency issued a Request for Proposals to select a CEAO and is currently reviewing applications.
The proposed rules open a 30-day public comment period and provide the framework needed to launch the program on schedule, including who qualifies, how to apply, what education expenses are covered, how providers participate and what safeguards are in place to protect taxpayer dollars. They include transparency measures to ensure accountability and regular reporting.
Public comments may be submitted to the Comptroller’s office and must be received or postmarked within 30 days of publication. Following the comment period, the Comptroller’s office will review feedback, make any appropriate revisions and move toward final adoption in accordance with state law.
Families may apply for an ESA beginning in early 2026, keeping the program on track to launch with the 2026–27 school year.
